Hyde Park Central School District

The Board of Education in its discretion may cancel all rights and benefits of employee organizations participating in or conducting strikes or other forms of work stoppages. Accordingly, the Board authorizes the following modifications be made to the wages and benefits of those employees participating in any unauthorized work stoppage:

  1. Loss of Salary: The Taylor Law requires that no public employee shall be compensated while engaged in a strike.
  2. Payroll Deductions: The Taylor Law requires that the School District deduct twice the employee's daily rate of pay for each day engaged in the strike. This deduction is a fine, and federal and state taxes must be deducted even though the salary penalty is not paid to the employee.
  3. Sick Leave: No sick leave will be approved once the strike or job action begins, and no striker will accrue sick leave for the period of absence.
  4. Payroll Deductions: Payroll deductions for credit union benefits, retirement, loans and annuities will not be made during a strike.
  5. Health Dental Insurance: All Contracts of Insurance will remain in force, provided that employees make arrangements to pay premiums. No insurance premium payments or contributions to Welfare Benefit Trust Funds will be made by the District on behalf of striking employees.
  6. Use School Facilities: Employees shall not be permitted to use school facilities during a strike if engaged in the strike.
  7. Contributions Retirement System: District contributions to the retirement system shall cease during a strike. Salary loss due to the wage deduction penalty of the Taylor Law is not to be included in the calculation of final average salary.
